Virginia Lane Splitting Law
Lane Splitting is not legal in Virginia and is considered reckless driving (or reckless riding).
The state of Virginia has been considering legalizing lane splitting for several years. In January 2020, Representative Tony Wilt submitted House Bill 1236 to amend the Code of Virginia to allow lane splitting by motorcyclists. Bill 1236 was referred to the Committee on Transportation, where it remained, never going anywhere.
In January 2022, House Bill 838, which would have made lane filtering legal under certain circumstances, was co-sponsored by state representatives Tony Wilt and Kathy Tran. The bill would have allowed for lane filtering for motorcycles if "overtaking and passing another vehicle that is stopped or traveling at a speed not in excess of 10 miles per hour in the same direction of travel and in the same lane."
HB 838 was referred to the Committee on Transportation, where it died in February of that same year.
Virginia Lane Splitting Law 2023
As of February 2023, no further action has taken place on lane splitting or lane filtering.
