Is Lane Splitting Legal in My State?
There's only one state that specifically legalized lane splitting, and that state is California. If you live in or are riding your motorcycle in California, you can feel great knowing that Lane Splitting is Legal in California. For many years California relied on an "it's not illegal" attitude. In 2016, California became the first and only state to make lane splitting explicitly legal.
In all other states, lane splitting is either specifically banned, or there's no law making it legal or illegal. In the states that don't have explicitly allow or ban lane splitting, it's left up to the individual police office to decide if the act was safe or negligent, meaning the officer has a lot of discretion when it comes to lane splitting.
There are a few states, like Kentucky, Tennessee, Ohio, West Virginia, Colorado, Louisiana and Delaware that are considering making Lane Splitting legal or illegal.
